Terms and Conditions

ALL THE QUOTATIONS ARE BASED UPON, AND ALL PRODUCTS ARE SOLD UPON THE FOLLOWING TERMS AND CONDITIONS. IF YOUR ORDER HAS NOT BEEN PREVIOUSLY ACKNOWLEDGED, THIS SHALL CONSTITUTE AN ACKNOWLEDGEMENT AND THE FOLLOWING TERMS AND CONDITIONS APPLY:

1. Buyer’s order is accepted on the condition that the terms and conditions set forth herein and/or special attachments hereto shall apply and shall constitute the entire agreement between the parties. Said terms and conditions may not be varied, and no modification or addition to them shall be of any force or effect unless made by or specifically accepted by the seller in writing. Accepting of Buyers orders which contain conditions of purchase printed thereon will not be binding upon Seller unless specifically agreed to in writing by the Seller. If any conflict exists between the terms and conditions herein set forth and those in Buyers order, the terms and conditions herein stated shall govern.

2. All quotations and/or agreements are contingent upon strikes, lockouts, work stoppages, war, riot, availability or materials, fire, accident or any other cause beyond Seller’s control. Seller shall have no liability for any delay, failure to deliver, loss or damage which might result therefrom.

3. Time for delivery shall not be of the essence of the agreement. Seller will make best efforts to meet stated shipment or delivery dates, but shall not be liable for any loss or damages resulting from delay, howsoever caused or occasioned.

4. The minimum invoice billing is $25.00. No discounts are allowed unless accounts are current. Interest charges of 1-1/2% per month will be assessed on past due balances.

Buyer agrees to make payment within Seller’s terms of payment. Seller may at anytime alter or suspend credit, refuse shipment, or cancel unfilled orders when in Seller’s opinion the financial condition of Buyer or the status of Buyer’s account warrants same, or when delivery is delayed by fault of the Buyer is delinquent in any payment related to this or any other agreement with Seller.

5. Unless stated to the contrary on the face hereof, prices in quotations are firm for a period of 90 days from the date of the quotation. Catalog and web prices are subject to change without notice. In the event the deliveries are deferred or delayed by the Buyer, the Seller reserves the right to make such deliveries at the prices in effect on the day of shipment, irrespective of the price or prices originally acknowledged.

6. Unless stated to contrary on the face hereof, all goods furnished hereunder will be shipped F.O.B. point of shipment, and title and risk in the goods shall pass to the Buyer upon Seller’s delivery to the carrier at point of shipment. Any freight allowance which Seller may grant based upon the dollar value of the shipment, or upon the type of goods involved, shall be construed solely as a price term and not as a delivery term.

7. Typographical and/or mathematical errors made by Seller in quotation, acknowledgments or invoices are subject to correction. To be allowable, any claim of error in quantity shipped shall be made by the Buyer in writing, within 10 days after receipt of goods.

8. No goods may be returned without Seller’s permission, and if authorized for return, and RGA# (return goods authorization number) will be provided to you. You must display this RGA# on all correspondence, including but not limited to: outside of the package (clearly marked) being returned and on a copy of original packing slip/invoice (provide inside of the package with your return). Note that transportation charges must be prepaid by Buyer unless otherwise noted by Seller during the authorization process. All goods authorized for return are subject to Seller’s inspection and acceptance, and a minimum handling charge (restock fee) of 15% of the purchase price of goods. It is at the Seller’s discretion to take an additional amount should the product(s) be used, damaged, or missing. Refunds will only be allowed within 30 days from the date of purchase – no exceptions will be made.

Limited Warranty for Components

Century Fuel Products, located at 51225 Martz Road, Belleville, MI 48111 USA, warrants all goods expressly manufactured for Century to be free of defect in material and workmanship for a period of twelve (12) months from the date of purchase by the original end user.  The sole obligation of Century Fuel Products under this warranty is limited to replacing or repairing any part which is deemed to be faulty under normal conditions of use and service.  All claims must be made within 15 days of failure date, and part(s) must be returned to Century marked “Attention Warranty Claims” with freight prepaid within 30 days of failure date or the claim is void.  All returns must be authorized by Century with an RGA number assigned by Century and marked clearly on the return package.  All product(s) received without an authorized RGA number is subject to be returned to the sender collect.  On parts where Century functions solely as a distributor, the original manufacturer’s standard warranty will apply.

Century does not cover labor charges, travel time, removal/installation of equipment. Century is not liable for any gas leaks, water leaks, or vacuum leaks as a result of installation by the purchaser, nor any other contingent expenses.

This warranty is limited to the original end user.  Specifically excluded from this warranty are products which have been subjected to neglect, abuse, improper application, or damage caused by disasters, such as fire, flood, wind, and lightning.  Also excluded are products which have been repaired or adjusted by persons other than a licensed mechanic. Further excluded are Century products in which parts and products other than those manufactured by Century have been used. Unless the original end user can demonstrate to the satisfaction of Century Fuel Products that said repair or use of non-Century products has in no way contributed to the warranty claim.

Under no circumstance will Century be liable for consequential damages or any expense incurred by reason of the use or sale of any such equipment.  No express warranty other than that set forth above shall apply.  Any warranty implied by state law or country, whether merchantability or fitness for a particular use, shall be effective for any product solely for the duration of the warranty period.

Some states or countries do not allow limitations on how long an implied warranty lasts, so the above limitations may not apply to you.  In addition, some states or countries do not allow for the exclusion or limitation of incidental or consequential damages so the above limitations or exclusion may not apply to you.  This warranty gives you specific legal rights and you may have other legal rights which may vary by state or country.  

Information provided by Century, either by website, telephone, catalog, or any other means of communication is given after exercising due care in its compilation, preparation, and issuance; however, CENTURY DISCLAIMS ANY LIABILITY RESULTING FROM SUCH INFORMATION except for the obligation under warranty provided above to replace or repair the product or at Century’s option to refund the purchase price.

9. No cancellation, suspension or variation of an order accepted by the Seller shall be valid unless agreed to by Seller in writing, in the event of such agreement by Seller, Seller reserves the right to assess cancelation or other charges to indemnify against all loss, including profit on any part of an order that is canceled.

10. Buyer hereby agrees to indemnify and hold Seller safe and harmless against all loss or liability, either direct or indirect, for or on account of any claims, demands or suits, for any actual or alleged infringement or any letters patent, copyrights or trademarks, either domestic or foreign, arising from the manufacture and/or sale of goods herein in accordance with patterns, designs, specifications, drawings, or directions or technical information or data furnished to Seller by the Buyer.

11. Warranty and Disclaimer: The goods described herein are warrantied to be free from defects of workmanship and material, and Seller has sole option to repair or replace defective goods in lieu of repaying the purchase price thereof.  The Century product line has a 12-month warranty.  All other brands are subject to their company's warranty.  Seller’s liability is expressly limited to the purchase price of goods which prove to be defective in materials or workmanship, and Seller shall have no liability for any consequential loss, injury or damage of any nature whatsoever.  There are no warranties which extend beyond the description on the face hereof, and the Seller specifically excludes any other express or implied warranty of merchantability or fitness.

12. Quotations and all terms and conditions above set forth, and any agreement or sale which arises between Buyer and Seller shall be governed by and construed in accordance with the laws of the State of Michigan.

13. “We hereby certify that these goods were produced in compliance with all the applicable requirements of Sections 6, 7, and 12 of the Fair Labor Standards Act, as amended, and of regulations and orders of the U.S. Department of Labor.”

Shipping Policies: All delivery times are estimated from the time your order leaves our processing center.

Domestic Orders: The Century Fuel Products shipping department is able to ship to street addresses within the United States. The purchaser is responsible for providing the correct mailing address. Please be certain your address is correct regardless of your ordering process, before finalizing your order. We can not be responsible for goods delivered to the wrong address.

Orders shipped to Alaska and Hawaii: These orders can require an additional 2 – 3 day delivery time and extra shipping costs.

Order Processing Times: We typically try to process orders within 72 hours (except holidays and weekends). Orders submitted on weekends will process the next business day.

Domestic: All packages, unless otherwise stipulated, once processed, are shipped via UPS Ground(3-5 day service, not guaranteed). This service provides delivery confirmation for all of our orders. All delivery times are estimated from the time your order leaves our processing center.

International: All packages, unless otherwise stipulated, once processed, go out United States Postal Service Priority International or Express Mail International. Tracking numbers are given, but the postal service does not typically allow tracking of this number until the package has been delivered. Please note that minor adjustments to the shipping rate may be required depending upon the country of shipment and the CURRENT USPS shipping rates. We try to send orders for the fastest delivery time to you.

International Customs: The purchaser is responsible to pay any applicable taxes or duties that may apply. We do not calculate or collect taxes or duties from you. It is the purchaser’s responsibility to check the country and local regulations and policies of the receiving country and abide by those. It is the responsibility of the purchaser to be sure the Customs Department permits the shipment of our products to your country and what the duties or tariffs may be upon delivery. We will not provide a refund on the shipping of the package if it is refused by customs or by yourself, due to regulations and taxes or duties. If the package is seized by customs for any reason and the package is not returned to us, we can not issue a refund.

Incorrect Shipping Information: If a package is returned to Century Fuel Products due to an incorrect or incomplete shipping address provided by a customer, the customer will be responsible for the return shipping cost as well as the redelivery cost. Century Fuel Products is not responsible for packages delivered incorrectly or lost due to incorrect or incomplete shipping information provided by a customer.

Lost or Stolen Packages: Century Fuel Products is not responsible for lost or stolen packages that have a confirmed delivery to the address entered for an order. Upon inquiry, Century Fuel Products will confirm delivery to the provided address, date of delivery, tracking information and shipping carrier information for the customer to investigate.

DAMAGED PRODUCT, INCORRECT ORDERS, AND MISSING ITEMS: If you have received either damaged product(s), an incorrect order, or missing items, it is the responsibility of the Buyer to contact the Seller within 7 days of receiving said goods. If 7 days have passed there will be no exceptions and no exchange, credit or replacement parts will be sent.

Items not in Stock: We strive to have all of our products available for immediate shipment. In rare occasions, due to the popularity and high demand for our products and limited availability of ingredients, products may be on back order. We will take all necessary steps to advise you in a prompt manner if this situation occurs. If it is possible to ship a portion of an order, we will send out all available items and place the remainder as a back-order, to be shipped as soon as possible.

PRODUCTS NOT FOR RESALE: Any and all Century Fuel Products are purchased, or received as the result of purchase through a website owned and/or operated by Century Fuel Products. are NOT FOR RESALE; with the sole exception belonging to Century Fuel Products. authorized retailers and distributors. Any purchase of our products made by someone other than an authorized retailer or distributor is made under the terms of a retail sale, which is when someone who is in the business of selling, like Century Fuel Products., sells to customers who buy products for their own use and not for resale to others.

Price Changes: We will not issue a refund for any price difference resulting from a change in price. No exceptions will be made.
